VoloMedia Privacy Policy
VoloMedia helps you download premium audio and video content while maintaining your privacy. This policy describes when and how we collect information, what we collect, and how we store, use and protect it. The policy covers information connected with use of the VoloMedia website and service. VoloMedia is committed to respecting the privacy rights of our customers, visitors, users, and others who use VoloMedia ("VoloMedia Service") (collectively or individually "Users").
VoloMedia is a licensee of the TRUSTe Privacy Program. TRUSTe is an independent, non-profit organization whose mission is to build users' trust and confidence in the Internet by promoting that use of fair information practices. This privacy statement covers the site www.volomedia.com. Because this Web site wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by TRUSTe. The TRUSTe program covers only information that is collected through this Web site, and does not cover information that may be collected through software downloaded from this site.

Your agreement with VoloMedia is specified by the Terms of Service. The Terms of Service are available as a part of the sign up process and must be accepted before you can use our service.
When we collect information:
- VoloMedia will not collect any information about you without your consent to our Terms of Service.
- We will record the anonymous information you give us when you subscribe, and retain it until you unsubscribe.
- When you subscribe, VoloMedia software installed on your computer will help us track your use of content downloads, plays, shared content, emailed content, bookmarked content, clicks, of downloadable content and advertisements.
- When you unsubscribe, we will completely remove VoloMedia software from your computer and your subscription information from our records.
- When you download and install VoloMedia's software, we ask you for certain demographic information that we use to customize the content and the advertising provided to you through the VoloMedia service.
- When you complete and submit the forms to register as a publisher or as an advertiser in VoloMedia system, we ask you basic contact information in order to notify you of your request, your account access, and communicate other relevant information such as updates to the portal.
Volomedia Blog:
- VoloMedia hosts the VoloMedia Blog. This privacy statement does not govern the information collected and submitted on VoloMedia blog. You should be aware that any personally identifiable information you submit there can be read, collected, or used by other users/visitors of the blog, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit on our blog.
What we collect:
- When you subscribe, VoloMedia will ask and record your age, ZIP code, and gender. We do not collect any information such as an email address which personally identifies you. You may update this profile information at any time by e-mailing us at support@volomedia.com, or by contacting us through postal mail using the contact information listed at the end of this Privacy Policy.
- We will not record any other information, even if required by our partners for their own subscriptions.
- After installation, we collect information when you download and use downloadable media. This information may include its title, date and time of download and use, IP (Internet) address to which it was sent. The information may also include number of full and partial content downloads, full and partial content plays, full and partial ad plays, time-of-day stamps for all uses, what content was shared by email and to how many users, what content was bookmarked and to what services, the clicks on the "more" button, and what items were clicked on. We will also track new installations, new upgrades and installs of the VoloMedia service. None of this information is linked to other information that may personally identify you.
- When you request a publisher and/or advertiser account we request you submit your name, address, phone number and email address. You may optionally provide further information relative to your advertising needs and campaign budget, and podcast download data.
How we use and protect it:
- We will use non-identifying information to tailor the service to you, for example by delivering only advertisements relevant to your age and gender. We will aggregate and report this information to our content partners and advertisers, for example, to help them measure audience size and composition and we will use this information to improve our services to you and other users or new users.
- We do not, at this time, collect or share any personally identifiably information on our Users with any of our content partners. We do, however, share aggregated, anonymous reports on our user base, including demographic information with content partners so that they can understand the makeup of the audience for their podcasts, and make better decisions about how to serve that audience. For example, we may tell a publisher that the average age of the audience for one of its recent podcasts was 28. These reports will not contain any personal information concerning Users.
- If you submit personal information to us via our VoloMedia Service (e.g., by e-mailing us for support), we intend to use your personal information to fulfill your requests and in providing the service. In that process we may share your personally identifiable information with our employees, contractors, or agents doing work for us.
- If you submit personal information to us via our Publisher and Advertiser registration form, we intend to use your personal information to fulfill your requests to use VoloMedia service. In that process we may share your personally identifiable information with our employees, contractors, or agents doing work for us. We will only provide those individuals and companies the personal information they need to deliver the service. In all cases, these individuals and companies are subject to agreements that require them to maintain the confidentiality of your information and they are prohibited from using that information for any other purpose.
- Unless you explicitly request additional information from VoloMedia, the only e-mails you receive from us will be confirmation e-mails and critical service updates.
- We require all persons doing work for VoloMedia to comply with our Privacy Policy, and we use reasonable efforts to limit their use of personal information. We may also provide your personal information to third parties with your consent.
- In certain limited circumstances, we may be called upon to release your personally identifiable information in response to a court order, subpoena, search warrant, law, or regulation, or to comply with state or federal law. We plan to cooperate with such requests. VoloMedia also reserves the right to support the prosecuting of users who, in our judgment, violate our Terms of Service or injure or interfere with VoloMedia's or others' rights or property, even when this may require disclosure of your personal information.
- VoloMedia does not share, sell, rent, or trade your personal information with third parties for their promotional purposes.
Use of Cookies:
- A cookie is a small text file that is stored on a user's computer for record-keeping purposes. We use cookies on this site, but we do not link the information we store in cookies to any personally identifiable information you submit on our site.
- Some of our business partners (such as advertisers or analytics providers) may also use cookies on their sites. We have no access to or control over these cookies. This privacy policy covers the use of cookies by www.volomedia.com only and does not cover the use of cookies by any advertisers or other third parties.
- We use both session ID cookies and persistent cookies. We use session ID cookies to help you navigate our site and to authorize your access to various parts of the site. We use persistent cookies to learn about usage of our site so that we can enhance it. A persistent cookie remains on your hard drive even after you close your browser. You can remove persistent cookies by following the directions provided in your Internet browser's "help" file.
- If you reject cookies, you may still be able to use our site, but your ability to use some areas of our site may be limited.
Choices you have regarding the collection, use, and distribution of your personal information:
- VoloMedia also tries to give you tools to ensure the information you have provided to us remains accurate and is used appropriately. If your personally identifiable information changes, or if you no longer desire to use our service, you may change or delete it by e-mailing us at support@volomedia.com or by contacting us through postal mail using the contact information listed at the end of this Privacy Policy. Also, if for any reason you are concerned with the way we are using your personal information, or would like to request that we delete such personal information, please contact privacy@volomedia.com.
- If you no longer wish to receive newsletters from VoloMedia, you may opt-out of receiving them by clicking on the link at the end of the newsletter.
Links and other sites:
- Please be aware that advertisers or web sites with links to our or our partners' sites may collect personal information about you. You should consult their respective privacy policies. This Privacy Policy does not apply to, and cannot control the activities of, those other advertisers or websites.
Merger, sale or bankruptcy:
- In the event that VoloMedia is acquired by or merged with a third party, we reserve the right, in any of these circumstances, to sell or otherwise transfer the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. Therefore, you should know that in such event, your personal information may be treated like any other VoloMedia asset, and sold, transferred or shared with third parties, or used in ways not contemplated or permitted hereunder, without notice to you or your consent.
- The VoloMedia Service is not intended for persons under the age of 13, and VoloMedia will not knowingly collect personal information from children under 13. We will promptly delete any such information as soon as we learn about it.
Confidentiality and security:
- VoloMedia uses physical, managerial and technical safeguards to preserve the integrity and security of your personal information. Though VoloMedia uses these safeguards, no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
- VoloMedia will attempt to notify you by email, if we are in possession of your email address, of any security breach that requires your attention. If you have a legal right to receive notice of security breaches in writing, please contact privacy@volomedia.com.
Changes to this privacy policy:
- This Privacy Policy may be revised periodically. Please revisit this site to stay aware of any changes. In general, we will only use your personal information in the manner described in the Privacy Policy in effect when we received the personal information you provided. If we decide that we would like to use your personal information in a manner that is materially less protective of your privacy than the Privacy Policy in effect at the time we received your personal information, we will seek to provide Users notice and obtain consent to the new use or disclosure. Privacy Policy changes will be indicated by a change to the effective date at the end of the policy. We will post a notice and link to our main Web page.
